Who we are
These Terms of Service (“terms”) apply to Tamvya, the label design and printing service at tamvya.com and in the Tamvya app (“the service”). The service is provided by Tamvya, an individual business (sole proprietorship) based in India. In these terms, “Tamvya”, “we” and “us” mean that business, and “you” means the person or business using the service. Your agreement for the service is with Tamvya.
By creating an account or using the service, you agree to these terms. If you keep using the service, you continue to agree to them. If you use the service for a business, you confirm you can accept these terms for it. If you don’t agree, please don’t use the service.
Your account
- You need an account to use Tamvya. You must be at least 18 years old, or old enough to make a binding contract where you live.
- Give a working email address and keep your password safe. You’re responsible for what happens in your account.
- Tell us at once if you think someone else is using your account.
- An account is for one person. Don’t share sign-in details or create accounts to get around plan limits or free trials.
Workspaces
Your labels, products, printers and plan belong to a workspace. A workspace is created for you when you first sign in, and you are its owner. The owner manages the workspace’s plan and billing. Each plan includes 1 user.
Plans and plan limits
Tamvya has a Free plan and two paid plans, Pro and Business. What each plan includes, such as the number of active designs, prints and exports, spreadsheet rows per print and AI credits, is shown on the pricing page and in the app. These limits are part of these terms.
- “Unlimited” features are for normal business use (fair use). If use is far beyond that, for example automated use that strains the service, we may contact you, slow it down or set a limit.
- AI credits are part of a plan. They have no cash value, can’t be transferred and don’t carry over to the next month.
- On the Free plan, if you have more designs than the plan allows, the extra designs become view-only until you upgrade or archive some. We don’t delete them because of a plan change.
- We may change what plans include. If a change reduces what you have already paid for, it applies from your next renewal and we will tell you first.
Free trials
- Pro trial. Every new account gets a 14-day Pro trial once, without a card. It starts automatically when you confirm your email address (or straight away with Google sign-in) and includes 20 prints, spreadsheet printing up to 2,000 rows per print and 10 AI credits. When it ends, your workspace moves to the Free plan unless you subscribe.
- Business trial. You can try Business free for 14 days, once, without a card. It includes 20 prints, spreadsheet printing up to 10,000 rows per print and 10 AI credits. When it ends, your workspace goes back to the plan it had before.
- Trials are free, so nothing is charged and nothing renews when they end. Each trial is available once per person, workspace and email address. We may refuse or end a trial that is being misused.
Prices, payments and renewals
- Prices. Which prices you see depends on your device’s time zone: if it’s set to India time, prices are shown in Indian rupees; everywhere else, in US dollars. Prices are before tax. In India, GST is added where applicable. Outside India, Paddle adds sales tax or VAT where it applies. The total, with any tax, is shown at checkout before you pay.
- Billing. Pro and Business are subscriptions billed monthly or yearly, in advance, as you choose at checkout.
- In India, you buy from Tamvya, and payments are made in Indian rupees and processed by Razorpay.
- Outside India, you buy through Paddle, as explained in the next section.
- Renewals. A subscription renews automatically at the end of each monthly or yearly period, at the price then in effect, until you cancel. We will tell you at least 30 days before a price change applies to your renewal.
- Failed payments. If a renewal payment fails, we or our payment provider may try again for a short time. If it still fails, your workspace moves to the Free plan.
- We don’t see or store your full card or bank details. They are handled by Razorpay or Paddle.
Orders outside India (Paddle)
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders outside India. Paddle provides all customer service inquiries and handles returns for those orders.
For those orders, Paddle’s buyer terms also apply to your purchase. If these terms and Paddle’s buyer terms differ about payment, tax, cancellation or refunds for a Paddle order, Paddle’s buyer terms apply. These terms still apply to how you use the service.
Cancellation
You can cancel a subscription at any time from the Billing page in the app. Cancellation takes effect at the end of the period you have paid for: your plan keeps working until then, and your workspace then moves to the Free plan. Our Refund Policy explains when you can get your money back.
Refunds
You can ask for a full refund within 14 days of any payment. The details are in our Refund Policy, which is part of these terms. For orders outside India, Paddle handles refunds and Paddle’s buyer terms apply; Tamvya still honours the full refund within 14 days for those orders.
Our service and its ownership
Tamvya owns the service, including its software, templates, design and the Tamvya name and logo, and all intellectual property in them. These terms give you the right to use the service while your account is open; they don’t transfer any ownership to you.
Your content
Your designs, text, logos, images, product and stock records, barcode values and other material you put into Tamvya (“your content”) belong to you, and so do the labels you make with it. You give us permission to store, process, copy and display your content only as needed to run the service for you, for example to save your labels, show previews, create AI drafts you ask for and print.
You’re responsible for your content. Make sure you have the right to use any logos, brand names, images and text you add, and that your labels are accurate and lawful. You can download your labels as PDF or printer files while you have access to them.
Barcodes, GS1 numbers and label rules
- Your numbers. Tamvya never creates barcode numbers. You type every barcode and QR code value. For retail barcodes and other GS1 barcodes, you are responsible for using numbers that your business owns or is allowed to use, usually licensed from GS1 in your country. Tamvya doesn’t issue, sell or license barcode numbers.
- Checks help, they don’t guarantee. Tamvya checks things like check digits, barcode size and layout before printing. These checks are there to help you catch mistakes. They don’t guarantee that a printed barcode will scan, and the camera check is a reading check, not a print-quality grade.
- No certification. Tamvya is not certified by GS1 and doesn’t certify that your labels meet GS1 standards, packaging, legal metrology, food, medicine or any other rules. You are responsible for what your labels say (for example MRP, weights, dates, ingredients and licence numbers) and for checking printed labels before you use them.
- GS1 is a trademark of GS1 AISBL. Tamvya is not affiliated with or endorsed by GS1.
AI drafts
- Suggestions only. AI drafts are suggestions to help you start a label. They can be incomplete or wrong. Check and edit every draft before you print it; you are responsible for the descriptions you type and for the labels you make from a draft.
- Your words, not ours. The AI is designed to use only the words you give it and never fills in barcode or QR code values. Don’t include personal or sensitive information in your descriptions.
- Use it fairly. Don’t use AI drafts to make unlawful, misleading, hateful or infringing content, or to get around the AI’s safeguards. We may block a request, remove a draft or suspend AI drafts for an account that does.
- AI drafts are limited by the AI credits in your plan, may be unavailable at times and may change as we improve them.
Printers and printing
Tamvya can print through your browser, as PDF files, to Zebra printers through ZPL files, and to label printers through their drivers. Printers, drivers, settings and label materials vary, and we don’t guarantee that the service works with any particular printer or label. Print a test label before a large run. We’re not responsible for labels, ribbons or other materials used in printing.
Acceptable use
Don’t use Tamvya to:
- break any law, commit fraud, or make labels that are false, misleading or counterfeit, or that copy another business’s brand or barcode numbers without permission;
- infringe anyone’s intellectual property or other rights;
- send spam, or harass anyone, or store content that is unlawful or harmful;
- upload malware, or try to break, overload, probe, scrape or get around the security, limits or plan checks of the service;
- copy, resell or reverse engineer the service, or access it by automated means except through features we provide.
We may remove content or suspend accounts that break these rules.
Reporting infringement
If you believe content in Tamvya infringes your rights, email support@tamvya.com with the details and how to find the content. We will look into it, remove content that infringes, and close the accounts of people who infringe repeatedly.
Availability and changes
We work to keep Tamvya available and reliable, but we can’t promise it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance, and we may add, change or remove features. Some features may be marked as early access and may change more often.
Disclaimers and limits of liability
The service is provided “as is” and “as available”. To the extent the law allows, we don’t give any warranty that it will meet your needs, or that labels made with it will be accepted by any retailer, marketplace, authority or scanner.
To the extent the law allows:
- we are not liable for indirect or consequential losses, lost profits, lost business, wasted labels or materials, or costs of recalls or re-labelling;
- our total liability to you for all claims about the service is limited to the amount you paid for the service in the 12 months before the claim.
Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer under the law of your country.
You agree to cover our reasonable losses and costs if a claim is made against us because of your content or your breach of these terms.
Suspension and termination
You can stop using the service and ask us to delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, that doesn’t pay, that puts the security of the service or other users at risk, that is used for fraud, or where we must by law. Where it’s reasonable, we will warn you first and give you a chance to download your labels. After an account is closed, we delete its data as described in our Privacy Policy.
Complaints
If something goes wrong, email support@tamvya.com first; we reply within 2 working days. If it is a complaint, we acknowledge it within 48 hours and resolve it within one month of receiving it.
Governing law
These terms are governed by the laws of India. Courts at Guntur, Andhra Pradesh, India have jurisdiction over any dispute, subject to any rights you have under the law of your country. Before going to court, please contact us so we can try to resolve the problem.
Changes to these terms
We may update these terms. If a change is important, we will tell you by email or in the app before it takes effect. If you keep using the service after that, the new terms apply. If you don’t agree, you can cancel and stop using the service.
